1. Scope
These General Terms and Conditions of Sale (“GTC”) apply to all orders of clothing and accessories sold online by Nevice, a company registered with the Paris Trade and Companies Register under the number: 898 213 6178 (“Seller”), to consumers (“Buyer”).
By placing an order, the Buyer acknowledges having read, understood, and accepted these GTC. Any contradictory terms in the Buyer’s documents are not applicable.
2. Products
The Products are presented on the Seller’s website, with photos, descriptions, sizes, colors, and prices.
Despite efforts for accuracy, slight variations in colors or sizes may occur. Availability is subject to stock.
3. Orders
Orders are placed via the Seller’s website. A confirmation email is sent to validate the order.
The Seller reserves the right to cancel or refuse any order in case of stock unavailability, errors in pricing, or incomplete information.
4. Prices
Prices are indicated in Euros (€), inclusive of French VAT, and exclusive of shipping costs unless otherwise specified.
The Seller reserves the right to update prices at any time, but the price at the moment of order confirmation applies.
5. Payment
Payment is made online via secure methods (credit card, PayPal).
Payment is required in full before shipment of the Products.
6. Delivery
Products are delivered to the address provided by the Buyer. Delivery times are indicative and may vary depending on stock and carrier availability.
The Buyer must inspect the package upon receipt and report any visible damage to the carrier immediately.
Risk transfers to the Buyer upon delivery.
Shipping fees are indicated at checkout and borne by the Buyer unless stated otherwise.
7. Right of Withdrawal
In accordance with French Consumer Code (Articles L221-18 et seq.), the Buyer has 14 days from receipt of the Products to withdraw from the purchase without reason.
To exercise this right, the Buyer must inform the Seller via email or the website’s contact form. Products must be returned in their original condition and packaging.
Return costs are borne by the Buyer unless otherwise agreed.
Refunds are processed within 14 days of receipt of returned Products, using the same payment method as the original order.
8. Returns and Exchanges
Products can be returned or exchanged within the withdrawal period. Items must be unworn, unwashed, and in original packaging with all labels attached.
The Seller reserves the right to refuse returns that do not comply with these conditions.
9. Warranty
Products are covered by the legal guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code) and conformity to the order.
The Buyer must notify the Seller of any defect within 2 years of delivery.
The warranty does not cover normal wear, improper use, or handling of the Products.
10. Intellectual Property
All content on the website, including photos, texts, designs, and logos, is the property of the Seller.
Any reproduction, distribution, or commercial use without written authorization is prohibited.
11. Personal Data
Personal data collected is processed according to GDPR and French data protection law.
Data is collected solely for order processing, delivery, customer service, and legal obligations. The Buyer has rights of access, correction, and deletion, exercisable by contacting the Seller.
12. Force Majeure
The Seller is not liable for delays or failure to perform obligations due to force majeure events, such as strikes, natural disasters, transport disruptions, pandemics, or government restrictions.
13. Governing Law and Dispute Resolution
These GTC are governed by French law.
In case of a dispute, the parties will attempt amicable resolution. Failing that, the courts of the Seller’s registered office have exclusive jurisdiction.
